Worker's Compensation

Worker's Compensation payments for lost wages and medical
expenses are a benefit available to almost all employees,
full time or part time, when hurt in the course of their
employment. In the Tri-State area, work injuries are very
common, accounting for payments of literally billions
of dollars annually. It is also one of the most hotly
contested areas of the law. The Insurance Industry insists
that many workers fake injuries to defraud the system.
Year after year, and with great effect, the Insurance
Industry and the large self insured corporations badger
the State Legislatures to change laws to limit benefits.
Unfortunately, being large, wealthy and willing to persevere,
they often win.
As with any State organized system, there is no guarantee
that the injured worker will actually receive benefits.
It is the duty of the injured worked to prove his entitlement
under existing State statutes, regulations and Court determined
case law. While the matter is being fought, the injured
worker is not entitled to benefits, or possibly even medical
care for the injury. Pain, loss of job, loss of self esteem,
loss of health benefits, home and family are all too often
the unanticipated but real disasters that face the injured
worker.
Only the most experiened lawyer should handle a worker's
compensation matter; never decide to handle it yourself.
The Insurance industry and many employers have full time
legal staffs, whether as part of their company or by hiring
well qualified Law Firms to handle compensation claims.
These are big money issues to your employer, his compensation
insurance carrier and the Firms that represent them. Your
claim is taken very seriously, you must do the same.
It is often said that "nice guys finish last."
Nothing could be more true in the Worker's Compensation
arena. You can not be nice and "go along with them" and win. For it is a game, and they have the ball. It's
called money. You must be assertive, not aggressive, to
win. Your lawyer, as your advocate, must be highly experienced
in the Law and possess in depth medical knowledge to win
and obtain all the benefits you deserve.
Your lawyer should, and must, represent you in these three
basic areas:
1. protect and defend your rights under the law
2. educate
you as to your rights and your responsibilities, even
if they appear burdensome and unfair and
3. understand and obtain all benefits to which you are
entitled in coordination with your Worker's Compensation
benefits.
We pride ourselves on our many years of service to the
injured worker and our reputation in the community as
attorneys who vigorously fight for the rights of the injured
worker.
